Terms and Conditions of Use

This Agreement constitutes a legal agreement between any person browsing or using the Site (hereinafter the "User") and the Quebec Beverage Container Recycling Association (QBCRA) (hereinafter "CONSIGNACTION"). In the event of disagreement with the terms of this Agreement, the User shall immediately cease use of the Site.

1. YOUR ACCOUNT

By ordering or purchasing products or services offered on the Site, the User may create an account. The User is solely responsible for maintaining the confidentiality and security of their account information and must not disclose this information to anyone. Users are entirely responsible for the activities that occur or pass through their accounts and agree to notify CONSIGNACTION in the event that the security or confidentiality of their accounts is compromised. CONSIGNACTION shall not, at any time, be liable for any damages or losses resulting from unauthorized use of Users' accounts. The User agrees to disclose and transmit information that is complete, accurate, and truthful when required to disclose or transmit such information using the Site. The User agrees to keep this information up to date in the same manner. The User agrees that CONSIGNACTION may use this information to keep the billing charges related to the User's account up to date.

2. LINKS TO OTHER SITES

Our Service may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third-party's site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

3. INTELLECTUAL PROPERTY

The trademarks and logos used or displayed on the Site are registered or unregistered trademarks and logos of CONSIGNACTION or third parties. Nothing on the Site may be interpreted in such a way as to allow, directly or indirectly, the use of such trademarks or logos without the prior written permission of their owner. Without limiting the generality of the foregoing, it is prohibited to reproduce the trademarks and logos displayed on the Site for commercial or advertising purposes or to increase the volume of visitors to the User's site.

All elements of the Site (including, without limitation, text, articles, photographs, images, illustrations, audio and video clips, software, etc.) are protected by copyright and belong to CONSIGNACTION or to third parties acting as content providers. Unless clearly stated otherwise, no element of the Site shall be interpreted as granting the User any right with respect to the intellectual property of CONSIGNACTION or a third party acting as a content provider.

Without the prior written permission of the owner, the User may not copy, reproduce, modify, publish, broadcast, distribute, participate in the transfer or sale of, create new works from, translate, download, sublicense, or otherwise exploit any element offered on the Site (including any software), in whole or in part.
Users may download, publish, or copy elements of the Site for personal, non-commercial use only, provided that they retain all intellectual property notices contained therein. Copying or storing any element for purposes other than personal use is strictly prohibited without the prior written permission of CONSIGNACTION or the copyright holder identified in the intellectual property notice.

4. LIMITATION OF LIABILITY

This Site, including the content and services it offers, is provided to you "as is" without any warranty, either express or implied. The information, software, products, and services published on this Site may contain inaccuracies or errors, including pricing errors. In particular, CONSIGNACTION and its subsidiaries do not guarantee the accuracy and disclaim any responsibility for errors or inaccuracies relating to the information and description of the products and services offered or displayed on the Site. In addition, CONSIGNACTION expressly reserves the right to correct any pricing errors on the Site and/or any purchases or orders in progress made at an incorrect price.

Without limiting the generality of the foregoing, in no event shall CONSIGNACTION, its affiliates, and/or their respective suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the access to or use of the User's posting or the use of this Site, whether such liability is based on negligence, contract, tort, extracontractual obligation, strict liability or otherwise, even if CONSIGNACTION, its affiliates and/or their respective suppliers have been advised of the possibility of such damages.

5. COMPENSATION

The User hereby agrees to defend and hold harmless CONSIGNACTION, its directors, officers, managers, shareholders, employees, affiliated companies, representatives, and content providers from any monetary judgment in principal, interest, judicial and extrajudicial costs, and any other damages, including, but not limited to, all reasonable legal fees incurred by CONSIGNACTION in connection with any claim, suit, action, or formal notice (hereinafter "Claim") arising from:

(i) any content submitted, posted or transmitted by the User on the Site;
(ii) the use by the User, or any person using the User's account, whether authorized or not, of the Site, your connection to it or any other violation of this Agreement;
(iii) any violation of applicable laws and regulations or the rights of a third party.

6. NEWSLETTER OR OTHER COMMUNICATIONS FROM BGE

By accepting this Agreement, the User agrees to be included in the mailing list created by CONSIGNACTION and authorizes CONSIGNACTION to send them all information regarding the use of the Site, the products and services offered on the Site, new features and special offers on the Site, new surveys, and other information deemed relevant by CONSIGNACTION. Users may unsubscribe from the mailing list at any time by contacting us at the following email address [email protected] and indicating that they no longer wish to receive such communications. Such unsubscribing does not prevent the User from being bound by this Agreement.

7. APPLICABLE LAW

By using this Site, including any order or purchase on the Site, the User acknowledges and accepts that this Agreement and any Claim, lawsuit, action or formal notice arising from the use of the Site, including any order or purchase, shall be governed by the laws applicable in the Province of Quebec and by the federal laws applicable in Canada. The User hereby irrevocably acknowledges and submits to the exclusive jurisdiction of the courts of the Province of Quebec, judicial district of Quebec, with respect to all disputes arising from this Agreement and its use of the Site.

8. RETURNS AND REFUNDS

CONSIGNACTION does not accept returns or refunds on merchandise sold. If you experience any difficulties with your equipment, please contact us by email at [email protected] or by phone at 1-877-CANETTE.

9. DELIVERIES

Shipping rates are based on the contents of your order and the delivery address. CONSIGNACTION does not ship outside of Quebec. Please allow 5 to 10 business days for delivery. *Please note that delivery times may be slightly longer during busy periods such as sales (Black Friday, Boxing Day), the holiday season, and during various events beyond our control. Due to various strikes/pressure tactics by postal services, delivery times may also be longer than usual.
